MANDATORY COMMUNITY GUIDELINES
Zippex (“Us”, “We”, “Our”) values its community. Our community comprises Our Customers Service Providers, Clients and every other individual or entity who work in connection with Us, in varied capacity. We intend to build a safe, respectful and inclusive environment for everyone who is associated with Zippex. For this purpose we have thoughtfully crafted Our Community guidelines which are binding for all the individuals and entities who are associated with Zippex in any capacity. This Mandatory Guideline is Applicable to all Users, Customers, Delivery Personnel, third party Service Provider, Merchants including any individual or entity who are associated with Zippex in any capacity (“Zippex Community”, “Affected Person” “You”, “Your”).
The members of the Zippex Community are acting in individual capacity and hence a separate “Independent Individual or Entity”. This Community Guideline does not create any agency or employer–employee or affiliate relationship between the members.
OUR VALUES AND GENERAL CODE OF CONDUCT
1.SAFETY, RESPECT AND INCLUSIVE
We strive Our best to provide a safe and secure Web experience through which Customers feel safe using the Services provided by Third Party Service Providers through the App and although the services of such Third Party Service Providers are not under Our control, however We strive to make sure that Your experience with Zippex is safe secure and HAPPY!
We do not tolerate any kind of discriminatory, harmful or illegal activity against Zippex Community as mentioned herein below and hence every member of the Zippex Community must not violate any of the terms mentioned in this Guideline. When You click the “I AGREE” button You agree to be bound by this Community Guideline as well and this is a Binding Contract between every member of the Community and Zippex.
In case of violation of this Guideline, You may be restricted either permanently or temporarily from accessing Our Website as per Our discretion and We reserve the right to take legal action including but not limited to the following (“Restricted Practices, Actions and Activities”) (The definition of the terms and circumstances mentioned in this section shall be construed as per applicable Criminal Code of British Columbia and/or federal laws in Canada in force):
Any verbal or physical acts of violence or gestures, vulgar, or an act that threatens the other Person or entity (whoever it may be). This could include anything said or done which is violent, abusive, harmful or creates a sense of attack, violence, or fear or an impending threat.
2.DISCRIMINATION
Racial, gender or sexuality, age, nationality, caste, creed or community related discrimination. Sexual or Gender Biased Behaviour or Approach: Verbal or physical, gesture or expression, direct, indirect or innuendo which is sexual or gender biased in nature is strictly prohibited.
Rude comments or behaviour or expression against any person of varied sexual or gender preferences or religious or community beliefs. Any action, gesture, or expression which is disrespectful or hurtful is strictly prohibited.
3.ACTS UNDER THE INFLUENCE OF DRUG OR ALCOHOL
Any verbal or physical acts or expressions or gestures done under the influence of alcohol or drugs which are abusive or disrespectful in nature is strictly prohibited.
Forcing or demanding a Delivery Personnel to enter the premises of the Customer, the Delivery Personnel shall not be bound to enter the premises of the Customer whether for the purpose of receiving or delivering the Item requested to be delivered.
4.UNETHICAL ACTIVITY, VIOLATION OF PRIVACY
Conduct any fraudulent activity through Our Website/App. Interfering with the code of the App, engaging any person to hack the system of the website/App, or conducting any phishing activity, click-bait, link to any virus on the Website/App. Introducing any virus or disabling code or any other unethical activity which compromises the safety of the Website/App.
Theft or misappropriation of property. Either by self or engaging any Delivery Personnel, third party or entity to plan and execute theft of property or items. Deal, sell, exchange or otherwise any activity personal or commercial, any Restricted Items or illegal items through the Services provided through Our App
Handing over any package for delivering any item which essentially causes mental or physical harm to any person or entity whatsoever. Handing over a package, whether a box or a container, or otherwise, containing an item which is digital or physical or in any solid, liquid, gas or biological form which can affect the health and safety of the community at large.
Spreading through the Website/App or Social Media, or distributing through Delivery package any personal, criminal or political or other agenda or propaganda in the form of a pamphlet or flyer or related material in digital or physical or whatsoever format or design.
An intention or agenda or propaganda expressed whether digitally or tangible or intangible form, which displays, incites or encourages directly or indirectly any sort of:
(i) crime, public outrage or nuisance or threat to war or violence;
(ii) sexual or voyeuristic display, expression, indications or innuendos;
(iii) false, fake or disrespectful expressions relating to any religious, community beliefs or misconceptions, fake news, or propaganda regarding any community, race, religion, political or otherwise, invitation to take part in any organisation or activity;
(iv) Any harmful or life threatening, or in general any threatening objects or displays or expressions digital or physical format which threatens in any way or creates fear in the mind of the receiver;
(v) demand charity, or demand or extort money or other high value items from any person or entity. Fraudulent activity relating to commercial purposes such as sale of fake items, or spreading an advertisement for the sale of counterfeit or stolen products or to deceive the public at large through the advertisement of sale;
Saving, sharing or distributing whether for commercial purpose or otherwise, personal information of any member of Zippex Community. Creating fake information via artificial intelligence, or otherwise, including but not limited to taking photos, screenshots of the Zippex Website/App with Personal information of Customers and Users. Gaining unauthorised access into Customers’ and Users’ accounts. Any Private Information of the Zippex Community must be strictly kept confidential dealing with Private Information in any way is prohibited by Law
5.INTELLECTUAL PROPERTY
Copy, edit, save, reverse engineer, or misuse of Intellectual Property of Zippex, misrepresent Your association with Zippex. Use of the brand name, logo which is unauthorised by Zippex. Using the brand name, or marketing material whether in physical or digital form, which is not connected to the Services facilitated through this Website/App
6.COMMUNICATION WITH DELIVERY PERSONNEL
We request every member of the Zippex Community to be kind and compassionate and respectful, and inclusive.
We request especially the Customers and Users to be patient and kind to the Delivery Personnel, in case the Delivery does not reach on time, We are striving to provide You the best of experience but due to unforeseen circumstances and/or technical glitch, or other situation beyond Our reasonable control the Delivery might get delayed.
Communications must be strictly professional. All directions to the Delivery Personnel must be mentioned in the App, in case of communicating with the Delivery Personnel the request should be strictly limited to Delivery directions which must comply with the Delivery Standards mentioned in the User Terms and Conditions. Any request or favour from the Delivery Personnel in return for monetary or other compensation is strictly prohibited.
EVIDENCE OF RESTRICTED PRACTICES, ACTIONS AND ACTIVITIES
Any person or entity guilty of breaching the terms of this Mandatory Guidelines, is considered the ‘Offending Party’. You are required to take the following actions or approach the Police Authorities in case of Criminally offensive actions:
WHAT YOU CAN DO
(i) Save a picture and/or video of unboxing, if already unboxed, then save a picture or video of the Restricted Practice or Activity in the same condition as the package contents arrive. Share such photos and/or videos with the Zippex Authorised Person for the purpose of investigation on Our part.
(ii) In case the Restricted Practice or Activity is relating to an individual or entity, You may capture a picture and/or video of the circumstances and share with Us only. You are restricted from sharing it on any social media or public platform. If the photo or video of the circumstances includes the face of any individual or entity, whether partially or in whole, You are required to keep such photo or video strictly confidential and not share it with any person or entity whatsoever apart from the directions of Zippex Authorised Person and/or Police or Legal Authorities.
(iii) Keep all pictures and/or videos of Restricted Practice or Activity relating to an individual or entity strictly confidential in Your possession only. You understand and agree that personal information and identity must be strictly kept confidential and must not be disclosed in any person, entity, or public forum whatsoever, apart from Zippex Authorised Person and/or Police or Legal Authorities.
(iv) In case of a Criminal Offence as per the Criminal Code of British Columbia or relevant Federal Laws, You may approach the Police Authorities directly.
(v) Acts of self defence: in circumstances of expression or display of violence or heated altercations from the other side, You may take necessary actions only to defend Yourself from hurt, including but not limited to stepping back and leaving the spot to avoid aggravating the situation.
Avoid taking the first step towards the other person in situations of heated altercations or abuse or any action which will lead You to mental or physical hurt or injury.
WHAT NOT TO DO:
In situations of Restricted Practice or Activity, You must avoid:
(The following is meant to keep You safe from harmful situations or restrict You from illegal actions and this is not a comprehensive list of actions, this is only meant to guide You):
(i) Spread the picture and/or Video of the Restricted Practice or Activity and share it on social media;
(ii) Spread the pictures and/or videos of the Restricted Practice on messaging applications or websites or ‘chatting’ applications;
(iii) create a public outrage or gain sympathy by spreading the pictures and/or videos of the Restricted Practice in the neighbourhood;
(iv) Directly approach the Delivery Personnel or Offending Party to harass or avenge Your hurt or discomfort or disrespect.
(v) Get into a verbal or physical altercation which may lead to mental or physical harm.
(vi) Involve members of Your neighbourhood or family to tackle the abusive or violent situation;
(vii) In case You are invited to join or involve Yourself in any procession, activity or society, or any secretive purposes or agendas, You are advised to avoid such invitations.

WE SHALL NOT AT ANYTIME SUPPORT ANY AGENDA WHETHER PERSONAL, COMMERCIAL, CHARITABLE OR ILLEGAL OR POLITICAL AND HENCE ANY ACTIVITY IN THE NATURE OF PROPAGANDA OR UNDUE INFLUENCE DOES NOT HAVE OUR SUPPORT APART FROM THE ONES WE EXPRESSEDLY DECLARE ON THE WEBSITE/APP OR SOCIAL MEDIA.
HENCE ANY RESTRICTED ACTIVITY CONDUCTED THROUGH THE WEBSITE/APP MUST NOT BE CONSTRUED AS A ZIPPEX AUTHORISED ACTIVITY.
COMPLIANCE TO THESE MANDATORY GUIDELINES IS THE RESPONSIBILITY OF EVERY MEMBER OF THE ZIPPEX COMMUNITY. WE CAN ONLY GUIDE AND DIRECT ACTIONS OR EXPRESSIONS BUT CANNOT CONTROL HUMAN BEHAVIOUR AND CANNOT CONTROL THIRD PARTY ACTIONS AND HENCE WE ARE NOT RESPONSIBLE FOR ANY COMPENSATION OR OTHERWISE FOR A BREACH OF THESE GUIDELINES WE CAN TAKE NECESSARY ACTIONS TO REDRESS THE SITUATION BY ENGAGING THE LEGAL AUTHORITIES TO RESOLVE THE ISSUES OR TAKE ADMINISTRATIVE ACTIONS.
RESTRICTED PRACTICES, ACTIONS AND ACTIVITIES BY DELIVERY PERSONNEL, THIRD PARTY SERVICE PROVIDERS ON THEIR OWN VOLITION OR IN CONNECTION WITH ANY ZIPPEX COMMUNITY MEMBER OR OTHER PERSON OR ENTITY OUTSIDE THE ZIPPEX COMMUNITY IS NOT OUR RESPONSIBILITY. OUR RESPONSIBILITY IS LIMITED TO THE MANDATES OF LAWS IN FORCE AND THE DECISIONS OF THE COURT OF LAW IN CANADA.
THESE COMMUNITY GUIDELINES ABOVE ARE NOT COMPLETE AND COMPREHENSIVE AND SUBJECT TO PERIODIC CHANGES. WE RESERVE THE RIGHT TO MAKE NECESSARY ADDITIONS DEPENDING UPON CIRCUMSTANCES AND CHALLENGES. ZIPPEX MAY SUSPEND OR DEACTIVATE CUSTOMER, DELIVERY PERSONNEL OR MERCHANT ACCOUNTS FOR OTHER REASONS AS DEEMED NECESSARY IN OUR OPINION TO ENSURE THE SAFE AND RELIABLE OPERATION OF THE PLATFORM.
